Local governments make decisions that affect our lives. We see this in counties, cities, towns, villages, and other municipal entities such as school districts.
They often make mistakes. You can challenge the actions (or inaction) of local governments in New York through an Article 78 proceeding.
Zoning Law is an example. Sometimes local government zoning and planning departments harass local business owners. Our clients may need help understanding building codes, or getting a variance. Other times local zoning officials allow developers to build projects near residential housing without proper planning and against local zoning rules.
We can help. A half-hour consultation costs $100. If you want to go forward, we charge a minimum fee and initial retainer of at least $2500 in zoning and other municipal cases.
The process usually involves attendance at two or more public hearings, and then proceedings in Court. The Court will review the evidence that was presented at the public hearing (i.e. zoning board, planning board).
A good attorney at these hearings will make sure you have a good
record for the Court to review. Some meetings are less important and
you do not need a lawyer to attend. We will tell you when you need us
and when you don't, saving you money.
Please note that we can no longer handle zoning/municipal cases in
the Town of Guilderland, as Warren Redlich now serves on the
Guilderland Town Board.
